Worker’s Rights in South Africa

The South African government sets labour regulations that govern the employment and management of employees. Referred to as labour codes or employment laws, these regulations outline employer’s responsibilities, employees’ rights, and the regulations governing trade unions.

Under these laws, employers are obligated to ensure a safe working environment, offer fair compensation, respect employees’ rights, and adhere to proper procedures during the hiring process.

Key legislation includes the Basic Conditions of Employment Act, the Labour Relations Act, and the Employment Equity Act, each designed to safeguard various aspects of workers’ rights.

Basic Conditions of Employment Act

The South African Basic Conditions of Employment covers employee rights. It sets out the minimum lawful conditions for employment which all employers must adhere to, regardless of the size or type of their business. The BCEA covers the following essential areas:

Working Hours

It stipulates maximum working hours, ensuring workers are not overworked, typically, a maximum of 45 hours per week and no more than nine hours on any day if the employee works for five days or fewer per week.

Leave Entitlement

The act provides for annual leave, sick leave, maternity leave, and family responsibility leave, giving workers time to manage personal and family health needs without fearing loss of their jobs.

Minimum Wage

It outlines the minimum pay that workers are entitled to, aimed at preventing exploitation through underpayment.

The Basic Conditions of Employment also covers domestic workers minimum wages and working conditions. According to the BCEA, domestic workers working a seven hour day are entitled to approximately R163.33.

Notice of Termination

The BCEA specifies the notice period employers must give employees before terminating their employment, protecting workers from sudden job loss.

Labour Relations Act

The South African Labour Relations Act deals with the employer-employee relationship and details how the employer and employee conduct themselves.

The LRA sets limits on trade union organize and conduct themselves. It details requirements for strikes, lockouts as well as CCMA dispute resolution. And it lays out terms for fair and procedural dismissal.
